Terms of Service

Effective from: January 1, 2024

1. Introductory Provisions

These Terms of Service (hereinafter "ToS") govern the relationship between mobilComm Ltd, branch office (Company ID: 01492241, registered office: Nové sady 988/2, 602 00 Brno, Czech Republic), registered in the Commercial Register kept by the Regional Court in Brno, file number A 25805 (hereinafter "Provider"), and the client (hereinafter "Client") when providing services in the areas of:

  • Accounting and tax consulting
  • Web development and applications
  • IT infrastructure and network management
  • E-commerce solutions
  • Mobile applications

2. Subject of the Agreement

The subject of the agreement is the Provider's obligation to provide the Client with services according to a specific order or framework agreement and the Client's obligation to pay the agreed price for these services.

3. Conclusion of the Agreement

The agreement is concluded based on:

  • Written order from the Client and its written confirmation by the Provider, or
  • Signed framework agreement for the provision of services

Electronic communication has the same legal force as written form.

4. Price and Payment Terms

The price for services is determined according to the Provider's current price list or individually agreed in the order/agreement. All prices are stated excluding VAT unless expressly stated otherwise.

The Client is obliged to pay the invoice within 14 days from its issuance date, unless agreed otherwise. In case of late payment, the Provider may charge late payment interest of 0.05% of the outstanding amount per day of delay.

5. Rights and Obligations of the Provider

The Provider undertakes to:

  • Provide services in the agreed scope and quality
  • Inform the Client about the progress of solving the order
  • Maintain confidentiality about the Client's confidential information
  • Comply with applicable legal regulations including GDPR

6. Rights and Obligations of the Client

The Client undertakes to:

  • Provide the Provider with all necessary documents and information
  • Cooperate in solving the order
  • Pay the agreed price within the specified deadlines
  • Inform the Provider of any changes relevant to the provision of services

7. Liability and Limitation of Liability

The Provider is liable for damage caused by breach of its obligations under these ToS and the agreement. The Provider is not liable for damage arising as a result of:

  • Provision of incorrect or incomplete documents by the Client
  • Non-cooperation of the Client
  • Force majeure

8. Confidentiality and Personal Data Protection

The Provider undertakes to maintain confidentiality about all facts learned in connection with the provision of services. The processing of personal data is governed by applicable legislation (GDPR) and Privacy Policy.

9. Termination of the Agreement

The agreement may be terminated by:

  • Agreement of both parties
  • Notice with a notice period of 1 month (for framework agreements)
  • Withdrawal in case of material breach of the agreement by the other party

10. Final Provisions

These ToS are effective from January 1, 2024. The Provider reserves the right to change these ToS. The Client will be informed about the change in ToS by email at least 30 days before the change takes effect.

Relationships not expressly regulated by these ToS are governed by the legal order of the Czech Republic, in particular Act No. 89/2012 Coll., the Civil Code.
